Terms & Conditions

Effective from 29 August 2026

These Terms & Conditions govern the use of the NovaPro website and the purchase of website design, development, hosting, domain and maintenance services from NovaPro.

By purchasing a service from NovaPro, you agree to these Terms & Conditions.

1. About NovaPro

NovaPro provides website design and development services to businesses, organisations and individuals.

NovaPro may use third-party services and platforms to provide its services, including payment processing, communication, website hosting and business administration.

2. Website Services

NovaPro provides website design and development services according to the package or service selected by the customer.

The specific features, inclusions and limitations applicable to a customer are determined by the package purchased or otherwise agreed between NovaPro and the customer.

NovaPro will make reasonable efforts to deliver websites in accordance with the agreed requirements.

Customers are responsible for providing accurate information, content, images, logos, branding materials and other information required to create their website, unless otherwise agreed.

3. Payment

Website services must be paid upfront unless NovaPro agrees to another payment arrangement in writing.

Where a customer selects a maintenance plan, maintenance fees will be charged according to the billing frequency and price displayed at the time of purchase or otherwise agreed with the customer.

Payments may be processed through third-party payment providers, including Stripe.

NovaPro may delay commencement or pause work where payment has not been successfully received.

4. Domain Names

Where a domain is included with the customer's selected package, NovaPro will pay for and arrange registration of the domain for the applicable included period.

The included domain period is:

  • Starter: 1 year
  • Professional: 3 years
  • Premium: 5 years

The included domain is provided for the applicable period associated with the customer's package.

After the included period expires, the customer will be responsible for applicable domain renewal costs unless otherwise agreed with NovaPro.

The customer is responsible for providing accurate registration information and complying with the rules of the relevant domain registrar.

5. Website Hosting

NovaPro provides website hosting at no additional charge where hosting is included in the customer's selected package.

Hosting is subject to reasonable technical limitations and availability.

NovaPro may use third-party infrastructure and hosting providers to provide website hosting.

NovaPro does not guarantee that websites or hosting services will always be completely uninterrupted or free from technical problems.

6. Website Maintenance

Customers may purchase an ongoing maintenance plan.

Maintenance services may include website updates, content changes, technical fixes and other services specified in the customer's selected plan.

Maintenance plans do not automatically include unlimited redesigns, major functionality changes, new websites or substantial additional development work unless specifically included in the customer's plan.

NovaPro may charge additional fees for work outside the scope of the selected maintenance plan where agreed with the customer.

7. Cancellations

Customers may request cancellation of their order within 48 hours of placing the order.

Cancellation requests must be sent to: sales@novapro.com.au

Once the 48-hour cancellation period has passed, customers may not cancel an order due to a change of mind unless NovaPro agrees otherwise.

Nothing in this section limits or excludes any rights or remedies that a customer may have under the Australian Consumer Law or other applicable law.

8. Refunds and Consumer Guarantees

NovaPro does not provide refunds for change-of-mind requests outside the applicable cancellation period, except where NovaPro agrees otherwise.

Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot legally be excluded under Australian law.

Where required by law, NovaPro will provide an applicable remedy for services that do not meet the requirements of the Australian Consumer Law.

9. Customer Responsibilities

The customer agrees to:

  • provide accurate information to NovaPro;
  • provide content and materials required for the website;
  • ensure they have permission to use content, images, logos, trademarks and other materials provided to NovaPro;
  • review website information and request corrections where necessary; and
  • not request or use the website for unlawful purposes.

NovaPro is not responsible for claims arising from materials supplied by the customer where the customer did not have the required rights or permissions.

10. Intellectual Property

Unless otherwise agreed in writing, the customer receives the right to use the completed website for their business or personal purposes after payment has been received in full.

Third-party software, fonts, images, plugins, frameworks and other third-party materials remain subject to their respective licences and terms.

The customer is responsible for ensuring that materials supplied by them can legally be used on their website.

11. Third-Party Services

NovaPro may use third-party services to operate and provide its services, including:

  • Stripe for payment processing;
  • Google Workspace and Google Meet for business communication and client meetings; and
  • third-party domain registrars, hosting providers and other technology providers.

Third-party services may have their own terms and privacy policies.

NovaPro is not responsible for outages or failures caused solely by third-party services outside NovaPro's reasonable control.

12. Website Availability

NovaPro will make reasonable efforts to maintain website availability.

Temporary interruptions may occur because of maintenance, technical issues, security incidents, infrastructure failures, domain issues, third-party outages or circumstances outside NovaPro's reasonable control.

13. Limitation of Liability

To the extent permitted by law, NovaPro is not liable for indirect, incidental or consequential losses arising from the use of its services.

Nothing in these Terms & Conditions excludes liability that cannot legally be excluded under Australian law.

Nothing in these Terms & Conditions is intended to limit rights available to consumers under the Australian Consumer Law.

14. Changes to These Terms

NovaPro may update these Terms & Conditions from time to time to reflect changes to its services, technology, business practices or legal requirements.

The version applicable to a purchase will generally be the version in effect when the customer agrees to the relevant service, unless otherwise required by law.

15. Governing Law

These Terms & Conditions are governed by the laws of New South Wales, Australia.

Any dispute will be subject to the applicable laws and courts of New South Wales and Australia.
